Carver · Planning Board
Tuesday’s agenda also carries two solar arrays, battery storage, a new overlay district, and minutes from a meeting held in April.

CARVER — The Planning Board meets Tuesday with a notice that would start the clock on taking a cranberry parcel out of the state’s farmland tax program, and the parcel carries history.
The board meets at 6:30 p.m. in Meeting Room #1 at Town Hall. The agenda runs seven items. Area 58 TV records the proceedings.
The board does not decide whether the town buys the land. That choice belongs to the Select Board. What the board can do Tuesday is discuss and vote on a recommendation, and ask the questions that shape one.
The Fuller Street notice
Carver-Middleboro Cranberry Co., Inc. has filed a notice of intent to convert land at 0 Fuller Street, Assessor’s Map 50, Lots 1 and 10-B, out from under a Chapter 61A agricultural tax lien.
Under G.L. c. 61A, § 14, land taxed as agricultural cannot be sold for or converted to residential, industrial or commercial use without notifying the town. The notice goes to the Select Board, assessors, Planning Board, Conservation Commission and the state. The town then has 120 days to match a bona fide offer, or to buy at appraised value where no sale is involved. Miss the window and the option is gone.
The address should be familiar. As The G.O.A.T. News reported Oct. 9, the Earth Removal Committee found that ADGA Realty had taken roughly 8,100 cubic yards of material from 0 Fuller Street without a permit, and fined the company 40 cents a yard. That penalty rate ran higher than the 25 cents a yard the committee later set for ADGA’s permitted dig on Mayflower Road, a difference the minutes never explain.
The applicant on Tuesday is a different company, and the published record does not tie the Earth Removal Committee’s file to the map and lot numbers on this agenda. Whether the board asks about that history is the thing worth watching.
Environmental flags on this agenda
Farmland leaving protection. A Chapter 61A conversion is close to permanent. Once the 120 days run, the town’s leverage over what happens to an active cranberry parcel is gone.
A state forest buffer nobody measured. The Federal Pond site abuts Myles Standish State Forest. The Earth Removal Committee’s chairman has said the 50-foot buffer was “eyeballed” rather than surveyed.
A clearing limit in dispute. Carver’s bylaw caps deforestation for large ground-mounted solar at 30 percent of forested land, up to five acres per lot. The Federal Pond plan involves about 11 acres. The developer says the Attorney General struck the five-acre rule. The town’s online code still carries it, with no note of disapproval.
Battery storage. Both solar proposals pair panels with battery energy storage, which has drawn close scrutiny across Plymouth County and which the agenda describes only in passing.
Trucks. The Federal Pond earth removal permit was raised from 50 to 70 loads a day, and an operator’s representative said the job was running at about 95 percent of that capacity.
Federal Pond Solar, continued again
Federal Pond Solar, LLC is on the agenda for 104 Tremont Street, Map 123, Lot 13, in the Residential Agricultural district, seeking a special permit and site plan review for ground-mounted and dual-use panels with coupled battery storage.
The agenda notes the applicant has requested a continuance to Nov. 10. That is the second time this hearing has moved. It was continued to Oct. 13, then to Oct. 27, and now to Nov. 10.
The proposal covers roughly 21 acres of panels on a property of about 780 acres, with a dual-use array over an active bog. The developer has described the array as sitting “primarily in the sand supply area.”
Parallel Products, and a vote
Parallel Products Solar Energy, LLC seeks a special permit and site plan review at 235 Main Street, Map 87, Lot 2-34E, for a large-scale ground-mounted overhead solar canopy. The parcel sits in both the Residential Agricultural and Tourist Commercial districts.
This one is listed for discussion and possible vote. The agenda gives no acreage, no panel count, and no indication of clearing or battery storage.
Also up for a possible vote is NLE Charging, LLC, seeking site plan review at 2 Montello Street for eight electric vehicle charging dispensers, four of them ADA spaces, with a parking canopy at an existing commercial lot.
A new overlay district
The board takes up proposed amendments to the zoning bylaw and zoning map to establish a new Article 4-13, a Smart Growth Overlay District, along with a separate amendment on temporary event parking on private property.
The agenda carries no draft text for either. Smart growth overlays concentrate housing density in designated areas, and Carver’s water resource protection districts sit across much of the town. Where the lines fall is the question, and the agenda does not say.
Context worth holding: this board rejected Carver’s Housing Production Plan on a 0-5 vote, with both of its sponsors voting it down, and voted 5-0 to delay using the state’s clean energy permitting process, saying the state was “taking authority away from local boards.”
Minutes from April
Under Other Business, the board will take up minutes for April 28, Sept. 15 and Sept. 29.
Those three dates matter. The G.O.A.T. News reported Sept. 25 that the town had posted minutes for 6 of the board’s 16 meetings this year, with nothing posted since May 26. All three of Tuesday’s sets were among those outstanding as of Oct. 9.
The Attorney General’s regulation treats minutes as timely when approved within three meetings or 30 days, whichever is later, absent good cause. April 28 is roughly six months back. The agenda for that April meeting carries a posting timestamp of Sept. 22.

Questions the agenda does not answer
Who owns the Fuller Street parcels, and what is the intended use. A 61A notice is triggered by a planned sale or conversion. The agenda names neither buyer nor purpose.
Whether the town wants the land. The 120-day clock is the only leverage Carver has, and it runs whether or not anyone acts.
What the Smart Growth Overlay would cover. No map, no boundaries, no draft text posted with the agenda.
Why Federal Pond keeps moving. Three hearing dates, no testimony taken, and a clearing dispute still unresolved.
This preview is drawn from the Carver Planning Board agenda for Oct. 27, 2026, from G.L. c. 61A, § 14, and from prior G.O.A.T. News reporting on the board, the Earth Removal Committee and the town’s meeting records. Items listed for discussion and possible vote may be continued or withdrawn without notice.
